CONDITIONS OF SALE

  1. The Contract (The Parties, the Subject Matter and the Service Offered)

A.1 – The online sales contract is a distance contract which, in this specific case, has as its subject the sale of wines produced and bottled by Nuraghe Crabioni and is entered into between the seller: T.S.U Nuraghe Crabioni di Soletta Umberto, Via Sassari 77, 07040 Florinas (SS), Italy – VAT No. 01152280903, and a customer, within the framework of an organized sales system conducted via the Internet.

For the purposes of this contract, the term Customer refers to the natural person, company, or business entity that, in relation to this contract, acts for purposes related or unrelated to any professional activity that may be carried out. Contracts are concluded directly through the Customer’s access to the website at www.nuraghecrabioni.it, where, by following the indicated steps, the contract will be finalized.

  1. Sale and Warranty of Products

B.1 – Products are sold in accordance with the terms and conditions of this contract, to the exclusion of any other terms or conditions, and with the characteristics described on the website www.nuraghecrabioni.it.

B.2 – All products marketed by Nuraghe Crabioni are covered by the official manufacturer’s warranty and, where applicable, by the provisions set out in Legislative Decree No. 24 of 02/02/2002, concerning certain aspects of the sale of consumer goods and related guarantees.

  1. Prices and Payment Methods

C.1 – All sales prices of the products displayed on the website www.nuraghecrabioni.it constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code and shall be understood to include VAT, calculated in accordance with the rates in force in Italy, in the case of delivery within Italian territory.

In the event of delivery of the products to a country within the European Union, VAT shall be determined according to the rates in force in that country; if the purchaser is registered with the VIES (VAT Information Exchange System), they may benefit from the option to pay VAT in the country of origin.

Finally, sales transactions involving delivery to non-EU countries are not subject to VAT in Italy and, therefore, the related prices do not include such tax.

C.2 – All prices are expressed in EURO and are subject to change. With regard to prices, products, and offers, www.nuraghecrabioni.it reserves the right to make changes based on changing market conditions, the discontinuation of product availability, or other mitigating circumstances. By accepting these conditions, the Customer makes a bank transfer or electronic payment in favor of Nuraghe Crabioni.

Orders shall not be binding on Nuraghe Crabioni until they have been accepted by the company. An order shall be considered accepted solely at the moment the payment is made via PayPal or credited to the bank account through payment made using the accepted credit cards.

  1. Delivery and Shipping Costs

D.1 – Products will be delivered to the address indicated by the Customer by courier within 30 (thirty) days from the day following the date on which the Customer has made the payment related to the order.

Nuraghe Crabioni will issue and send the Commercial Invoice, where requested at the time of the order, or the relevant Transport Document, which will accompany the products ordered by the Customer.

D.2 – Ownership of and risk relating to the products shall pass to the Customer at the time of delivery to the address indicated by the Customer at the time of the order. If the Customer accepts the goods with reservation, they must indicate the reason for such reservation (for example, if the package appears visibly damaged externally, this must be stated, failing which compensation may not be granted).

D.3 – Shipping costs are determined based on the weight of the products, the destination market, and the shipping method. For shipments to non-EU countries, any applicable customs duties shall be charged.

Before confirming the order by providing payment information, the shipping cost and destination can be viewed in the order summary panel under “shipping costs”.

D.4 – No duplicate shipments will be carried out; therefore, in the event that the package is visibly damaged, only monetary compensation equal to the value of the damaged bottle will be provided.

  1. Product Availability

E.1 – In the event of unavailability, even temporary, of the requested products, Nuraghe Crabioni undertakes to inform the Customer within the timeframes and in the manner provided for by Article 6.2 of Legislative Decree No. 185/1999, and to refund the price paid by the Customer.

Upon written request, the Customer may alternatively receive products of equivalent value as a replacement for those ordered.

Nuraghe Crabioni shall not be held liable for service disruptions attributable to force majeure events such as accidents, explosions, strikes, and/or other unforeseeable or unexpected events that may prevent, in whole or in part, the performance of the contract within the agreed timeframes. In such cases, Nuraghe Crabioni’s liability towards the Customer shall be limited to the refund of the price paid.

  1. Acceptance of Products and Right of Withdrawal

F.1 – The Consumer has 60 (sixty) days to notify Nuraghe Crabioni in writing of the existence of any defects or faults in the products; this period shall commence from the moment the Consumer becomes aware of the defect. This right shall lapse if it is not exercised within 26 (twenty-six) months from the date of delivery of the goods.

  1. Obligations of the Purchaser

G.1 – The Customer declares that they have reviewed these general conditions before accessing the online purchase procedure and undertakes, once such procedure has been completed, to print and retain the automatic order receipt as well as the specific characteristics of the product purchased.

Legislative Decree No. 206/05

Right of Withdrawal (Legislative Decree No. 206/05)

The Customer has the right to withdraw from the contract entered into with Nuraghe Crabioni, without any penalty and without providing any reason, within 10 (ten) business days from the date of delivery.

Exclusions

The Customer may not exercise the right of withdrawal for “contracts for the supply of goods made to measure or clearly personalized, or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly.”

Procedure for Exercising the Right of Withdrawal

The right of withdrawal shall be exercised by sending, within the prescribed time limit, a written notice to Nuraghe Crabioni by registered letter with acknowledgment of receipt.

The notice may also be sent, within the same time limit, by telegram, telex, email, or fax, provided that it is confirmed by registered letter with acknowledgment of receipt within the following 48 hours. The registered letter shall be deemed to have been sent in due time if delivered to the accepting post office within the time limits established by law or by contract, where applicable. In any case, the acknowledgment of receipt shall not constitute an essential condition for proving the exercise of the right of withdrawal.

Nuraghe Crabioni Srl
Via Umberto I, 30
07037 Sorso (SS), Italy

  1. Termination of the Contract and Express Termination Clause

H.1 – The obligations assumed by the Customer pursuant to the section OBLIGATIONS OF THE PURCHASER, as well as the guarantee of successful payment made by the Customer through the methods referred to in the section PAYMENT METHODS, are considered essential. Therefore, by express agreement, the Customer’s failure to comply with any of these obligations shall result in the automatic termination of the contract by operation of law, without the need for judicial intervention, without prejudice to the right to take legal action against Nuraghe Crabioni for compensation for damages.

Jurisdiction and Competent Court

Any dispute relating to the application, execution, interpretation, and breach of the purchase contracts entered into online through this website www.nuraghecrabioni.it shall be subject to Italian jurisdiction.
